Planning restrictions placed on Hereford public house

The owners, occupier and brewery of the Broadleys pub in Hereford have had restrictions placed on what they can do with the building. Herefordshire Council has issued a direction which removes the permitted development rights that had been associated with the property. The notice, formally known as an “article four direction” means that the owners must now seek a planning permission if they wish to change the use of the building.

Until the council issued the direction, the owners of the Broadleys would have been permitted to change the use of the building to a shop, restaurant or office without planning permission.  Now they will have to get planning consent from the council if they wish to change the use of the building. The restrictions apply to the site so they will remain in place even if the pub changes hands.

Any planning applications made for the site would be assessed by the council on its merits against the council’s planning policies.

The council is now consulting on the article four direction until 26 March 2015. It will then have six months to consider whether the direction should be extended or withdrawn.

Marc Willimont, Head of Development Management & Environmental Health said:

“The Broadleys is a popular local pub and appears to be a thriving business. There had been concerns about the possibility of converting the site to a supermarket. Although the article four direction does not prevent that taking place, it does mean the owners will now have to get specific planning consent if they wish to do so.”
